Back in 2019, during a holiday break, Elio first chatted with one of our directors, Maryanne, after a referral from a family member who held True Blue Migration in high regard. The Subclass 400 Temporary Work visa is for those highly skilled individuals who have met the health and character requirements and genuinely want to do short-term specialist work in Australia. The “wait and gain experience” advice worked out for our client as he picked up the skills required for his role in Australia.
In 2020, the Australian Government brought in the subclass 408, Temporary Activity visa (C-19 Event), which allowed temporary visa holders to stay in the country legally while the borders were shut. Most of these visa holders were eligible to apply for a subsequent visa up until February 2024, after which the 408 visa (Covid-19 Event stream only) closed permanently. This was a huge relief for those already in work who could consider their options, and, if they met the criteria, look into other visa routes. For Elio, the subclass 820 and 801 visa pathways were viable options.
The Subclass 820 Partner visa is a temporary visa that allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily, as the first step towards their permanent Partner Visa (subclass 801)
To qualify, you must be 18 or older and not have had a visa cancelled or turned down or be holding certain regional visas. You must be in Australia when applying and have a sponsor approved by the Department. Your sponsor cannot change for at least 2 years after your temporary Partner visa subclass 820 is lodged in order to be eligible for the permanent visa (subclass 801)
Subclass 820 allows you to live, work and study in Australia, with no limits on overseas travel. You can apply for Medicare and, if eligible, attend free English language classes provided by the Adult Migrant English Program.
Dependent children may be included in your application, provided they meet the health and character requirements and are currently in Australia when you apply.
Two years after lodging your temporary partner visa, provided you have continued to meet all the visa conditions and relationship requirements, you are eligible to apply for the subclass 801, permanent Partner visa. Once your permanent Partner visa has been granted, you receive permanent residency. Permanent residency via a Partner visa entitles you to live, work and study in Australia, sponsor eligible family members to come to Australia, travel to and from Australia for 5 years while the travel facility on the visa remains valid and attend Free English language classes if eligible. Finally, once you meet the relevant criteria and requirements, you may be able to apply for Australian citizenship.
