Partner visas are closely scrutinised by the Department of Home Affairs. A successful application depends on the quality and quantity of evidence of your genuine and ongoing relationship.
You need to show that you live life as a couple, through financial commitments, a shared household and social recognition. If you are living in Australia, certain States allow you to officially register your relationship. This is crucial if you have not lived together for 12 months when you lodge your application.
Many partner visa applications are a two-part process. You apply for a temporary visa first, and two years after lodging it, you provide further information to substantiate your commitment. If you meet the requirements, you are then granted permanent residency. Long term couples – such as those with three years continuous cohabitation – or two years and a child together – can bypass the temporary stage.
Once your partner visa is granted, you have full work rights and you can live anywhere in Australia.
If your partner visa is lodged whilst you are in Australia (this option is available to married and de facto couples), you may go onto a bridging visa that will allow you work during the processing time.
